1. We endeavor to update our guaranteed pricing monthly. Between our pricing updates, the pricing of our competitors may change.

2. Our pricing guarantee is only applicable to the regular price of the benchmarked competitor at the time of our last pricing update. Our pricing guarantee is not applicable to the current competitor’s pricing.

3. Our product quantity may differ from that of the compared benchmarked competitor. In such cases, our comparison is based on unit pricing.

4. Our product flavor may differ from that of the compared benchmarked competitor if the competitor does not have the flavor we sell.

5. If the benchmarked competitor reduces their price between our pricing updates, their price might be lower than ours.

6. If the benchmarked competitor runs a promotion, their price might be lower than ours.

7. Your price at sale is the final price. We do not make any retroactive price adjustments or refunds with regards to our pricing guarantees.

8. We encourage you to compare our prices to other places you shop to ensure you get the best deal.

9. The pricing guarantee on a product, only extends to the pricing of the competitor mentioned in the guarantee. It does not extend to other competitors’ pricing or products.

10. Our pricing guarantee for any product is effective only while the offer lasts.

11. Our pricing guarantee only covers the regular purchase price for one item on a consumer account on the competitor’s platform. Our pricing guarantee does not cover any promotions, deals, subscription savings, coupon codes, special savings, instant savings, bulk/wholesale/quantity discount, business account pricing, seasonal sales, bundle offer, typographical errors on competitors’ platforms, clearance, closeout, flash sales, special events, rebates, Buy one, get one free (BOGO), introductory or first time customer offers, or any special or limited duration pricing. Our pricing guarantee does not cover pricing of out of stock/unavailable products or free products. If a competitor is currently running a promo that makes its pricing more competitive than ours, we encourage you to take advantage of it! It’s what we’ll do!

12. For products sold on Amazon, our pricing guarantee applies as follows:
      – If Amazon.com is a listed seller for a product, our pricing guarantee extends only to Amazon.com’s pricing (see exception below)
      – If Amazon.com is not a listed seller for a product, our pricing guarantee extends only to the Buy Box pricing.
      – In situations in which Amazon.com is a listed seller for a product but is not the Buy Box seller, we reserve the discretion to either benchmark to Amazon.com’s pricing or the Buy Box pricing.
      – For any product, our pricing guarantee applies to the total of the purchase price and any other delivery/transaction fees charged to Amazon Prime members.

13. For Costco.com pricing guarantees, we may benchmark to the higher pricing between Costco.com or sameday.Costco.com.

14. For competitors that maintain physical stores and an online store, our pricing guarantee shall only extend to the competitor’s online store pricing closest to our zip code – 53222. Our pricing guarantee does not cover any in-store pricing.

15. Our pricing guarantee does not extend or cover any typographical errors we make. We reserve the right to correct any errors including after an order has been placed.

16. In no circumstances shall our pricing guarantee cause us to give a product for free or to owe a credit for purchasing a product.

17. We reserve the right to stop selling any product we offer. Our pricing guarantee in no way compels us to sell any product.

18. We reserve the right to modify or terminate any pricing guarantee for any product at any time without prior notice.

19. WE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION PROVIDED UNDER THIS GUARANTEE. WE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS GUARANTEE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

20. To the fullest extent permitted by law, we will not be liable for any damages arising out of offering our Pricing Guarantees, including but not limited to direct, indirect, incidental, consequential, and punitive damages.

21. This Guarantee shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws provisions.

22. Any dispute arising out of or relating to our offering of pricing guarantees will be resolved only through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Milwaukee, Wisconsin. Each party shall be solely responsible for its arbitration fees. The arbitrator’s decision will be final and binding on both parties.
